This war memorial is built on land which has no effective owner. The triangle of land was gifted to the residents of Kakanui in 1928 and four trustees were appointed by the residents, however no provision was made to replace those trustees in the future. Now [as at 2014 but for many decades] that three have died leaving just The Crown as the only surviving and unwilling trustee, the plot of land cannot be properly managed and, for instance, Waitaki District Council has no mandate to repair the memorial nor maintain the surroundings.
This could change if the residents wanted it to happen, as The Crown has agreed that it could have the land re-vested in Waitaki District Council at no cost to residents, on an application by them, to Land Information New Zealand.
Something needs doing to regularise the land ownership - it's certainly not an issue where the memorial is at risk, but it would take the land from a very unique status to one where it is just the same as most of Waitaki's war memorials, that is owned by and looked after by the council.
