This is a photo of a replica of the Statue of Liberty. Therefore, the location of the marker (next to the real statue in New York Harbor) is incorrect.
I think the whole picture is a construct. It looks like the Verrazano Bridge, but the City (NYC)doesn't sit right behind it. Also, there's no viewing place raised like that which is that close to the Statue of Liberty. It's an interesting composite, but that's what it is...a constructed scene.
You are right on the money with that! I went to a website about Obaiba, and the same picture was there. It was either lifted from the site, or was submitted by the same photographer.
