依据《开罗宣言》、《波茨坦公告》中华民国于1946年从日本收复南沙群岛，同时以一系列法律程序向全世界宣告中华民国恢复行使对南沙群岛的主权，包括举行接收仪式和派兵驻守，绘制南沙群岛地图，重新命名南沙群岛及其群体和个体的名称，编写和出版最早的南沙群岛地理志。 由于中华民国与中华人民共和国双方都宣称自己继承了《开罗宣言》与《波茨坦宣言》中提到，日本应归还的领土权，因此迄今为止双方尚未能就主权争议达成较接近的共识，各自坚持自己拥有整个南沙群岛的完整主权。 1958年9月4日，中华人民共和国发表关于领海的声明，14日，越南民主共和国（北越）政府主席范文同在给中华人民共和国总理周恩来的照会中表示：“越南民主共和国承认和赞同中华人民共和国政府一九五八年九月四日关于规定中国领海的声明”，“越南民主共和国政府尊重这一决定”。
